What is a Domestic Violence Injunction?

A domestic violence injunction—sometimes called a restraining order—is a court order that helps protect individuals from violence or the threat of violence. You may file a petition if you:

Have been a victim of domestic violence, or
Have reasonable cause to believe you are in imminent danger

You do not need an attorney to file a petition, and there is no filing fee.

Types of Violence Covered

Florida law recognizes several types of violence that may qualify for an injunction:

Domestic Violence

Involving family or household members, spouses, or those with a child in common.

Dating Violence

Between individuals who have or had a significant romantic or intimate relationship.

Repeat Violence

Involves at least two separate incidents, with one occurring in the last six months.

Sexual Violence

Involves any incident of sexual battery, lewd acts, or forcible felonies involving a sexual act.

How to File an Injunction

To file a petition:

Visit a Clerk of Court office (locations below)
Bring a valid form of identification (driver’s license or similar)
Complete the required forms

You do not need an attorney to file a petition, and there is no filing fee.
