RE: Committee on Standards of Conduct Governing Judges - Your inquiry dated April 13, 1992.
You inquire whether you may serve with your husband as co-trustee of trusts created for the benefit of the adult daughter of close friends.
The ten members of the committee responding to your request unanimously agreed the acceptance of the appointment as co-trustee is violative of Canon 5 (D), prohibiting a judge from serving as trustee except for close family members. Even in the instance of a judge acting as trustee for a close family member, Canon 5 (D) prohibits a judge from serving as a trustee if such service interferes with the performance of judicial duties.
The committee is expressly charged with rendering advisory opinions interpreting the application of the Code of Judicial Conduct to specific circumstances confronting or affecting a judge or judicial candidate. Its opinions are advisory to the inquiring party, to the Judicial Qualifications Commission and to the judiciary at large. Conduct that is consistent with an advisory opinion issued by the committee may be evidence of good faith on the part of the judge, but the Judicial Qualifications Commission is not bound by the interpretive opinions issued by the committee.
