THIS
MATTER is before the Court on the State’s appeal from a sentence imposed by the
Pinellas County Court. In the trial court and court of appeal, the State argues
that the sentence is unlawful in that it withholds adjudication but does not
impose probation. Such a sentence has previously been held unlawful.
IT IS THEREFORE ORDERED that the sentence is reversed, and this case is remanded to the trial court so that the defendant may be re-sentenced in accordance with this Order and Opinion.
