This cause came before the Court on the Petitioner’s Motion To Declare Florida Statutes Section 322.28(5) Unconstitutional and the Respondent’s Response. Upon consideration of the same, the Court finds that Florida Statutes Section 322.28(5) is constitutional. Anderson v. Department of Highway Safety & Motor Vehicles, 751 So.2d 749 (Fla. 5th DCA 2000).
It is therefore,
ORDERED AND ADJUDGED that the Motion To Declare Florida Statutes Section 322.28(5) Unconstitutional is DENIED.
