RE:  SOCIAL SECURITY NUMBER IN FAMILY LAW CASES

            Various sections in Florida Statutes require the filing of a social security number in family law cases and restrict access to the social security number.  See e.g, sections 61.052(8), 61.13(9), 742.031(3) and 742.10(2), Florida Statutes. 

            In addition, section 119.071(5), Florida Statutes, provides that an individual’s social security number is exempt from public disclosure.

            Family Law Form 12.902(j), Notice of Social Security Number, provides a method for a party to file his or her social security number in a separate pleading in order to prevent unauthorized disclosure of the social security number.

            The Clerks of the Circuit Court in the Sixth Judicial Circuit should follow a consistent policy with respect to such confidential records. 

            In order to ensure the confidentiality of such records in the Court and comply with these statutory provisions, it is

ORDERED:

            1.  The Clerk of the Circuit Court for Pasco County and the Clerk of the Circuit Court for Pinellas County shall seal all filings of Family Law Form 12.902(j).  Such records shall be available to a party, a party’s attorney, and the attorney for the Department of Revenue but shall not be available for inspection or copying by the public without an order of the Court authorizing such release. 

 

            2.  The Clerk of the Circuit Court for Pasco County and the Clerk of the Circuit Court for Pinellas County shall take all steps necessary to ensure that such records are not released to the public.
