Canons 5C(4)(a) and 6(A) and 6(B)(2)

You inquire whether: 1) you must report receiving a free meal at a County Bar Association meeting; 2) whether you must report hotel and food costs paid by the lawyers' association you have addressed; and, 3) whether a free invitation to a Florida Bar CLE program must be reported as a gift.

A majority of the committee members responded to your inquiries and all expressed the view that under the Canons these gratuities and expenses are allowed without the obligation to report. However, one member, and I agree, especially as to your third question, suggested you also peruse the recent legislative amendments to Florida Statute 112 which provide an extensive definition of "gift" for public disclosure purposes.

The committee is expressly charged with rendering advisory opinions interpreting the application of the Code of Judicial Conduct to specific circumstances confronting or affecting a judge or judicial candidate. Its opinions are advisory to the inquiring party, to the Judicial Qualifications Commission and to the judiciary at large. Conduct that is consistent with an advisory opinion issued by the committee may be evidence of good faith on the part of the judge, but the Judicial Qualifications Commission is not bound by the interpretive opinions issued by the committee.
