February 7, 1978

Dear Judge:

The Committee on Standards of Conduct Governing Judges has considered your letter of January 16, 1978 and has decided, by a majority vote of the membership of the Committee, not to respond by formal published opinion. It is the view of a majority of the Committee that the propriety of any claim or alleged calim that you may have under any policy of insurance is a matter to be determined by negotiation or litigation between you and the insurance carrier and that ou may then dispose of the proceeds of the claim, if any, in such manner as you desire. In the words of one of the members of the Committee, "If it is a claim properly payable under that policy the Judge should accept it and do as he wishes with it."

Sincerly yours,

Tyrie A. Boyer, Chairman
Committee on Standards of Conduct Governing Judges
