Re: Canon 5B

Dear

You requested an opinion from the Committee on Standards of Judicial Conduct whether you should resign as a Board member of the Mental Health Clinic of your city. Your letter stated that you regularly preside at Baker Act hearings.

The Committee suggests a possible conflict, or appearance of conflict, and for that reason, suggest you might want to consider resignation.

On January 16, 1973, we recommended to a County Judge that he should not be a member of the Board of Directors of the "Guidance Clinic." Further on October 4, 1974, the Committee suggested to a Circuit Judge that he should resign as a member of the Board of Directors of a Guidance Clinic.

The Committee adheres to its previous recommendations, and suggests that you may want to consider resignation, in order to avoid any conflict or reasonable appearance of conflict.

With high esteem and warm regards, I am

/s/ GUNTER STEPHENSON, as Chairman
Committee on Standards of Judicial Conduct
