Your Inquiry Dated December 5, 1995
You inquire into the propriety of your endorsement of the naming of a street after the late Judge Frances Jamieson. You ask whether it would be permissible for you to appear at the Brevard County's Board of County Commissioners to voice your approval for the renaming of the street, or whether you can write a letter to the Chairman of the Brevard County"s Board detailing your support.
Support of this measure is clearly in the public interest due to the influence and impact Judge Jamieson had on Florida's legal development. Renaming the street is an activity that will raise awareness of the law, the legal system, and the administration of justice. You appearance at the Board meeting is permissible under Canon 5C(1). Your involvement is in furtherance of the legal system, and you may present your views in person or in a letter to the Chairman of the Board. You should seek to minimize the potential influence of your position in this matter by any means possible. Seven of the seven responding committee members agree your proposed action is permissible under the Code.
The Committee is expressly charged with rendering advisory opinions interpreting the application of the Code of Judicial Conduct to specific circumstances confronting or affecting a judge or judicial candidate. Its opinions are advisory to the inquiring party, to the Judicial Qualifications Commission and to the judiciary at large. Conduct that is consistent with an advisory opinion issued by the Committee may be evidence of good faith on the part of the judges, but the Judicial Qualifications Commission is not bound by the interpretive opinions by the Committee.
