You wish to know if you may accept a position on the Board of Directors of ....High School/....High School Foundation.

Eight responding committee members believe you may serve as such provided you do not participate in fund raising. Please review Canon 5B and 2B.

Three members add two caveats. You should take care to not allow the use of the prestige of your office for fund raising nor should you be involved in giving investment advice. These members also suggest you consider the frequency of any litigation that might involve school officials or students. This problem could arise if you preside in the juvenile division.

The committee is expressly charged with rendering advisory opinions interpreting the application of the Code of Judicial Conduct to specific circumstances confronting or affecting a judge or judicial candidate. Its opinions are advisory to the inquiring party, to the Judicial Qualifications Commission and to the judiciary at large. Conduct that is consistent with an advisory opinion issued by the committee may be evidence of good faith on the part of the judge, but the Judicial Qualifications Commission is not bound by the interpretive opinions issued by the committee. Petition of the Committee on Standards of Conduct for Judges 327 So2d 5 (Fla. 1976).
