Participation in sports event
You have asked whether Canon 5B(2) bars you and a colleague from participating in a fund raising sports event to the extent that one of you would hold a sideline marker and the other would check credentials at the press gate. It appears that you would not be identified either before or during the event as a member of the judiciary.
A majority of the committee has determined that Canon 5B(2) would not be offended by the activities described in your inquiry. A majority of the committee has distinguished the facts you have posed from those described in opinion 88/5, a copy of which is enclosed.
The committee is expressly charged with rendering advisory opinions interpreting the application of the Code of Judicial Conduct to specific circumstances confronting or affecting a judge or judicial candidate. Its opinions are advisory to the inquiring party, to the Judicial Qualifications Commission and to the judiciary at large. Conduct that is consistent with an advisory opinion issued by the committee may be evidence of good faith on the part of the judge, but the Judicial Qualifications Commission is not bound by the interpretive opinions issued by the committee.
