County Judge Amy Williams

ORDER AND OPINION

THIS MATTER is before the Court on Terry Williams’ appeal from an order of the Pinellas County Court summarily denying his motion for post-conviction relief.

After reviewing the brief and record, this Court affirms the decision of the trial court.

This Court has reviewed the order denying the defendant’s motion for post-conviction relief, and finds that it adequately refutes each of the defendant’s allegations.

The first two issues could have been raised on appeal; therefore, the defendant is procedurally barred from raising the issues. The third issue is without merit. See State v. Atkinson, 755 So.2d 842 (Fla. 5th DCA 2000).

IT IS THEREFORE ORDERED that the decision of the trial court is affirmed.

DONE AND ORDERED in Chambers at Clearwater, Pinellas County, Florida this _____ day of February, 2004.
