RE: SEALING OF CONFIDENTIAL DOCUMENTS
It has come to the attention of the court that there does exist a large
number of case files which contain psychiatric evaluations and/or pre-sentence
investigations of defendants which are made for the purpose of review by
the court and that said reports are filed in an open and public manner;
and
It is the opinion of the court that these reports are strictly confidential
in nature and should be sealed to prevent misuse of the information contained
therein, it is therefore
ORDERED:
1. The Clerk of the Circuit Court for Pasco County shall seal psychiatric
evaluations and/or presentence investigations of defendants, unless specifically
directed by the court that such documents shall remain public.
2. Documents sealed under this order shall be marked with the case style,
number and date of sealing, with the wording "SEALED - NOT TO BE OPENED
WITHOUT ORDER OF THE COURT".
3. This order shall not apply to juvenile and dependency cases because reports
in said cases are otherwise sealed by statute.
4. Pasco county administrative order 95-7 is hereby rescinded.
