Substitution of Parties - HRS/DOR


THIS CAUSE having come before the Court on its own Motion and having determined that by operation of law the responsibilities that the State of Florida's Department of Health and Rehabilitative Services has relating to Child Support Enforcement will be transferred to the State of Florida Department of Revenue effective July 1, 1994, and


WHEREAS this substitution of State responsibilities between executive agencies of the State of Florida is in like manner of substitution of public officers due to death or separation from office, and


WHEREAS such substitution of parties is controlled by the provisions of Rule 1.260(d) of Florida Rules of Civil Procedure, it is hereby


ORDERED:


1) In any action in which the Department of Health and Rehabilitative Services is a party by virtue of the Department exercising its authority to establish, modify and enforce support obligations or paternity pursuant to the provisions of Title VI-D of the Social Security Act, 42 USC, §651, et seq, the State of Florida Department of Revenue is hereby substituted as the party plaintiff or defendant in the stead of the Department of Health and Rehabilitative Services.


2) Effective July 1, 1994, the Clerks of the Circuit Court for Pasco and Pinellas Counties, shall take such action as is appropriate to modify the Clerk's records to reflect this substitution.


3) This Order shall apply to all actions described above and at the request of any party a copy shall be filed in any action which has not reached final disposition or in which post-judgment proceedings are currently pending, or in closed cases which are reopened after this date by the Department of Revenue exercising its authority to establish, modify and enforce support obligations for paternity pursuant to the provisions of Title IV-D of the Social Security Act, 42 USC, §651, et seq.


IT IS FURTHER ORDERED:


4) That any Order directing the Office of the Clerk of the Circuit Court for Pasco or Pinellas County to forward support monies they receive to the Department of Health and Rehabilitative Services is hereby amended and the Clerk is hereby directed to forward all such monies to Child Support Enforcement, Department of Revenue, 1170 Capital Circle N.E., Tallahassee, Florida 32301.
