ADMINISTRATIVE ORDER NO. 88- 19

 

 

RE: FAILURE TO APPEAR OR PAY CIVIL PENALTY

 

WHEREAS Rule 6.600(c) of the Florida Rules of Practice and Procedure for Traffic Courts has been amended effective January 1, 1989 to provide that a hearing may be requested within any reasonable period of time after the alleged offense has been committed, and

 

IN ORDER to provide for a uniform system in requesting such hearings, it is

 

ORDERED:

 

1) That the Clerk of the Court shall provide a form motion to any person seeking a hearing under the provisions of Rule 6.600(c) Florida Rules of Practice and Procedure for Traffic Courts for the movant to complete.

 

2) That upon completion, the Clerk shall forward the written notion requesting a hearing and the Traffic Court file to the assigned Traffic Court Judge on no less than a weekly basis for disposition without hearing.

 

3) That upon disposition, the Clerk shall notify the movant of the Court's disposition of the motion requesting a hearing pursuant to the provisions of Rule 6.600(c).
