ADMINISTRATIVE ORDER NO. 83-74

RE: Civil Incompetency Proceedings and Petitions for Writ of Habeas Corpus

To provide for the orderly and prompt consideration of civil incompetency proceedings and petitions for Writ of Habeas Corpus wherein a party is charged with a pending criminal offense,

IT IS ORDERED:

1. All such petitions for Writ of Habeas Corpus shall be assigned to a civil division in normal rotation and such file will then be transferred to the Criminal Administrator for consideration and disposition.

2. All proceedings pertaining to the competency of persons charged with criminal offenses shall initially be considered by the Criminal Administrator who shall retain jurisdiction thereof or transfer the same to a Judge of the Probate Division as he shall deem appropriate.
