Additional Warrants for Pay or Appear

IN THE CIRCUIT COURT, SIXTH JUDICIAL CIRCUIT

IN AND FOR PASCO AND PINELLAS COUNTIES, FLORIDA

 

ADMINISTRATIVE ORDER 2009-052 PI-CIR

 

IN RE:  ADDITIONAL WARRANTS FOR PAY OR APPEAR

 

            The District Court of Appeal in Akridge v. Crow, 903 So.2d 346 (Fla. 2d DCA 2005) found that “pay or appear” programs to enforce collection of court ordered costs and fines was unconstitutional.  Warrants have been issued under a “pay or appear” program that previously existed in Pinellas County.  Administrative Order No. 2008-082 PI-CIR was signed in order to cancel those warrants and provide for collection of the outstanding costs and fines.  Since that time, the Pinellas County Sheriff’s Office has identified additional warrants which were also issued under said program.  In order to allow for the cancelation of these additional warrants,

 

IT IS ORDERED:

            1.  The warrants listed in Attachment A are hereby recalled, cancelled, and are null and void.  The Sheriff of Pinellas County shall not execute any of these warrants and shall indicate in its electronic communication systems to the Sheriffs in the State of Florida that such warrants have been cancelled.

 

            2.  The Pinellas Clerk of the Circuit Court is hereby authorized to collect court costs and fines pursuant to § 28.246, Florida Statutes, from defendants listed in Attachment A. 

 

            3.  All other provisions of Administrative Order No. 2008-082 PI-CIR remain in full force and effect.
