ADMINISTRATIVE ORDER NO. 2006-084 PI-CIR

RE: INVOLUNTARY CIVIL COMMITMENT OF SEXUALLY VIOLENT PREDATORS

In order to clarify where such cases will be tried and in order to update provisions regarding attorneys’ fees, it is hereby

ORDERED:

1.  Section 60 is continued as a section within the Civil Division of the Circuit Court, in and for Pinellas County, Florida.

 

2.  The State Attorney may request an order seeking return of a respondent for a determination of counsel and a determination of indigence prior to filing a petition under the Involuntary Civil Commitment for Sexually Violent Predators’ Treatment and care Act, section 394.910 et. seq, Florida Statutes (Jimmy Ryce Act).  The request shall be made to the judge assigned to section 60.

 

3.  When the Clerk of the Circuit Court receives a petition under the Involuntary Civil Commitment for Sexually Violent Predators Treatment and Care Act, the case shall be assigned to section 60.  When a notice for trial is filed, the case shall be assigned at random to one of the other circuit civil sections.

 

4.  Section 60 of the Civil Division shall hear pre-trial matters of cases relating to the Involuntary Civil Commitment of Sexually Violent Predators’ Treatment and Care Act.

 

5.  Petitions relating to attorneys fees shall be in accordance with Administrative Order 2004-028 PA/PI-CIR and where court approval is required shall be directed to the judge assigned to section 60.

 

6.  Such proceedings shall be tried in the assigned civil section by the section judge or any other circuit or acting circuit judge.  Trials shall be held at either the Clearwater Courthouse or the St. Petersburg Judicial Building unless otherwise approved by the Chief Judge.

 

  Administrative Orders 2003-016 PI-CIR and 2006-076 PI-CIR are hereby rescinded.
