RE:     COURT REPORTING FEES FOR EAST PASCO AND PINELLAS COUNTY

Rule of Judicial Administration 2.070(g)(2) requires the Chief Judge, after consultation with the circuit court and county court judges in the circuit, to enter an administrative order developing and implementing a circuit-wide plan for court reporting of all proceedings required to be reported at public expense using full or part-time Court employees or independent contractors.

In Administrative Order No. 2004-018 PA/PI-CIR, the revised Court Reporting Plan for the Sixth Judicial Circuit was adopted on April 2, 2004, and amended in Administrative Order 2004-033 PA/PI-CIR, and Administrative Order 2004-099 PA/PI-CIR.  The rates for transcription of proceedings covered by the Court Reporting Plan were attached to the Plan.

Section 67 of Chapter 2005-236, Laws of Florida, requires the Trial Courts Administrator of each circuit to recover expenditures for State-funded services, including costs for transcription services, when those services have been furnished to a user of the State court system.

Therefore, in order to update the rates charged by the Administrative Office of the Courts for transcript fees, it is hereby

ORDERED:

            1.         That, effective July 1, 2005, the fees that will be charged by the Administrative Office of the Courts for transcription services of proceedings reported under the Court Reporting Plan, that is, those proceedings where the Court is required to provide a record, will be the calculated actual cost of the service including the cost of recovery.  In Pinellas County and Dade City, those rates are:

            2.         In New Port Richey, where the Circuit employs the use of a contract court reporter to provide court reporter services, the rates for transcription services will match the rates that the Circuit must pay for the services from the contract court reporter.  Those rates will be set in a separate Administrative Order; they are currently stated in Administrative Order 2004-030 PA/PI-CIR.

            3.         The procedures in the Court Reporting Plan for requesting and filing transcripts are unchanged.

            4.         Nothing in this Order shall affect the contracts entered into between the Court and any court reporter.
