RE:     LOCAL ORDINANCE VIOLATIONS

FISH AND WILDLIFE CONSERVATION COMMISSION VIOLATIONS

UNIFORM FINE SCHEDULE – AMENDMENTS

 

            Administrative Order No 2003-027 PA-CTY was adopted to update the uniform fine schedule and clarify the procedure for processing local ordinance violations in Pasco County. 

 

Chapter 2005-236, Laws of Florida, provides for additional costs to be assessed for local ordinance violations.  Section 22 of Chapter 2005-236, Laws of Florida, which amends section 34.045, Florida Statutes, provides that if a person does not contest a violation in court or if the county or municipality is the prevailing party, that $10 in costs shall be assessed.   

 

            Section 71 of Chapter 2005-236, Laws of Florida, which amends section 938.19, Florida Statutes, provides for the imposition of a $3 assessment for teen court upon the adoption of an ordinance by the Board of County Commissioners.  The Pasco County Board of County Commissioners has adopted section 34-8 of the Pasco County Code providing for a $3 assessment for teen court in accordance with the provisions of section 938.19, Florida Statutes.

 

            Therefore, in order to update the uniform fine schedule to address these statutory changes,

EXCEPTION: VIOLATIONS OF THE FOLLOWING STATUTES ARE NON‑CRIMINAL INFRACTIONS PAYABLE WITH A $50.00 FINE WITHIN THIRTY (30) CALENDAR DAYS.  ANY PERSON FAILING TO PAY THE CIVIL PENALTY OR FAILING TO APPEAR, HAVING ELECTED TO APPEAR OR BEING REQUIRED TO APPEAR, IS GUILTY OF A MISDEMEANOR OF THE SECOND DEGREE. NON‑CRIMINAL INFRACTIONS: Sections 327.73, 370.0605(1)(a), 370.0605(1)(b), 370.1111(1)(a), 370.14(10)(a), 372.57, 372.83, 372.988, Fla. Stat.
