ADMINISTRATIVE ORDER NO. 2004-005 PI-CTY

RE:      PROCEDURES FOR SETTING BOND FOR PERSONS WITH MENTAL HEALTH NEEDS

 

Administrative Order PA/PI-CIR-98-46 establishes a Uniform Bond Schedule and procedures for setting bond; and

 

State funding has become available to provide mental health services to defendants in Pinellas County; and

 

In order to establish procedures to effectively implement such services:

 

IT IS ORDERED:

             1.        Persons arrested for misdemeanor offenses may be voluntarily evaluated by personnel from Suncoast Center for Community Mental Health, Inc. (hereinafter Suncoast).

 

             2.        Upon recommendation by personnel from Suncoast, the booking officer may release to Suncoast the following persons:

 

                        A.  Persons arrested for misdemeanors except the following offenses:

 

                                    1.  Any offense involving violence

                                    2.  DUI  §316.193(3)(c)(1), Fla. Stat.

                                    3.  BUI  §327.35(3)(c)(1), Fla. Stat.

                                    4.  Non-domestic stalking  §784.048(2), Fla. Stat.

                                    5.  Failure to Appear  §843.15(1)(b), Fla. Stat.

                                    6.  Prostitution offenses, 2d and subsequent offense  §796.07, Fla. Stat.

                                    7.  All crimes of domestic violence  §741.28, Fla. Stat.

                                    8.  Violation of a domestic violence injunction  §741.30, Fla. Stat.

9.  Violation of a repeat, sexual or dating violence injunction §784.046(9)(b), Fla. Stat.

                                    10.  Violation of pre-trial release

                                    11.  Violation of probation.

 

                        B.  Persons arrested for criminal traffic except the following offenses:

 

                                    1.  DUI  §316.193 (2), Fla. Stat.

                                    2.  BUI  §327.35 (2), Fla. Stat.

 

                        C.  Local ordinance violations

 

 

             3.        This order is directed to processing of persons at booking and does not preclude a judge from establishing different conditions of release. 

 

             4.        All other terms and conditions of Administration Order PA/PI-CIR-98-46 shall remain in full force and effect.
