RE:     ASSIGNMENT OF CAPITAL POST-CONVICTION CASES

 

            Whereas, Rule of Judicial Administration 2.050(b)(4) requires the chief judge to assign post-conviction or collateral matters in cases where the defendant has been sentenced to death to a judge qualified to conduct such proceedings, and

 

            Whereas, Rule of Criminal Procedure 3.851(c)(1) requires the chief judge, within 30 days of the issuance of the mandate from the Florida Supreme Court affirming a judgment and sentence of death on direct appeal, to assign the case to a qualified judge, it is hereby

 

ORDERED:

 

            1.         The Clerk of the Court is directed to provide to the chief judge a copy of all mandates received from the Florida Supreme Court in which the Court affirms a judgment and sentence of death on direct appeal. 

 

            2.         The chief judge will assign a circuit judge qualified under Rule of Judicial Administration 2.050(b)(10) to preside over post-conviction or collateral matters in such cases.
