RE:   CONTINUANCES IN TRAFFIC INFRACTION CASES

 

 In order to establish standard procedures in Pinellas County for handling requests for continuances of traffic infraction hearings, it is hereby:

           

ORDERED:

 

            1.         Requests to County Court Judges.

           

(a)  The Clerk of the Court for Pinellas County shall refer all requests for continuance of traffic infraction cases set for hearing before a county court  judge to the presiding judge.

 

(b)  Except as provided herein, a written motion or request for continuance shall be timely filed with the Clerk of the Court for Pinellas County.  The motion or request must state with particularity the reasons for the request for continuance.  The motion shall be considered timely if it is filed three (3) days prior to the scheduled hearing.

 

(c)  In case of an emergency and the person is unable to file a written motion in accordance with paragraph (b) above, the Clerk of Court for Pinellas County shall refer any verbal request to the presiding county court judge.

 

            2.         Requests to Civil Traffic Infraction Hearing Officers.

 

            In any traffic infraction case set for hearing before a civil traffic infraction            hearing officer wherein the law enforcement officer(s) or the alleged offender requests a continuance of the hearing date, the request shall be directed to the Clerk of the Court who shall, based upon the direction of the presiding county judge either refer such requests for a continuance to the presiding county judge or grant one continuance of any such hearing to each side.

 

3.         The Attached form Motion for Continuance may be used to seek a continuance of civil traffic infraction hearing.

 

.           Pinellas County Administrative Order No. 97-12 is hereby rescinded.
