RE: COURT REPORTING PLAN – AMENDMENT FOUR
In order to amend the Court Reporting Plan to implement
changes to court reporting procedures in civil matters at the

A.2 of Administrative Order 2004-018 PA/PI-CIR is hereby amended as follows:

Currently, contract court reporters furnish court reporting
services for all in-court proceedings before judicial officers in

Family - Effective May 15, 2006,
parties in family law proceedings may use any certified court reporter except
that all proceedings in which the court is required to provide a record,
including but not limited to domestic violence proceedings pursuant to section 741.30,
Florida Statutes, and repeat, dating and sexual violence proceedings pursuant
to section 784.046, Florida Statutes, shall continue to be recorded by a
contract court reporter.
Probate - Effective
Contract
court reporters shall also continue to record all proceedings governed by the
Rules of Juvenile Procedure, criminal felony proceedings, criminal misdemeanor
proceedings, and criminal traffic proceedings. Nothing in this order precludes
the contract court reporters from accepting private appointments, including,
but not limited to, recording civil, family, and probate cases.
Effective
All
notices of hearings for proceedings for which the court does not provide a
record must specify whether the party setting a matter for hearing will be
securing the services of a court reporter.
All costs associated with the court reporter’s appearance will be the
responsibility of the party requesting the court reporter. This does not preclude the taxation of costs
as authorized by law. See

certified court reporters approved by the Sixth Judicial Circuit’s Administrative
Office of the Courts may be used. In
order to be approved, a court reporter must either hold a current certification
as a Registered Professional Reporter or other higher-level certification from
the National Court Reporter’s Association or be approved by the Administrative
Office of the Courts based upon training and experience. A list of certified
court reporters is posted and updated on the Circuit’s website at www.jud6.org.
If a court reporter arrives to report a particular proceeding but is not an
approved court reporter for the Sixth Judicial Circuit, the judge may, after
inquiry to determine the qualifications of the reporter, authorize the
individual reporter to report the specific proceeding.
Effective May 15, 2006, Administrative Order 2004-030
PA/PI-CIR is modified so that the rates established in that order only apply to
transcripts of proceedings where the court is required to provide a
record.
All other
terms and conditions of Administrative Orders 2004-018 PA/PI-CIR, 2004-030
PA/PI-CIR, 2004-099 PA/PI-CIR, 2005-038 PA/PI-CIR, and 2005-068 PA/PI-CIR shall
remain in full force and effect.
